Use of medical services is governed by the applicable provider’s terms, policies, and Notice of Privacy Practices.

12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OPTIMIZEMD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO OPTIMIZEMD IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless OptimizeMD and its affiliates from any claims, damages, liabilities, or expenses arising out of your use of the Website, violation of these Terms, or violation of applicable law.
14. Dispute Resolution & Arbitration
Any dispute arising out of or relating to these Terms or the Website shall be resolved through binding individual arbitration, except where prohibited by law.
You waive the right to participate in class actions, collective actions, or representative proceedings.
Arbitration will be conducted under the rules of a nationally recognized arbitration provider. Each party bears its own legal costs unless otherwise required by law.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

We may update these Terms from time to time. Continued use of the Website after changes constitutes acceptance of the revised Terms.
